Okay, so he has a soul.

So, one could argue, did Adolf Hitler.

Or Osama Bin Laden.

All men and women, created in the image of God, have souls, according to the 
texts of most of your name-brand religions.

And in the end, Hitler and Bin Laden have done more evil than anything that 
has yet to spring out of the Hellmouth.

I don't see Spike as being the nice guy, just because he's encumbered by 
having a soul. The chip stopped him from killing. A soul might not, he may 
just have to justify his actions, at least to himself. To know it's wrong, 
and not care, that's true evil! And I still say that Buffy's in a better 
condition in her head now, so she can actually say 'No' to ol' Duster Boy and 
mean it. Remember, Angel has a soul, and in 'The Yoko Factor', she told him 
to get out of Sunnydale.
