Delurking here for a moment to kick in my .02. I'm not up on criminal law, but wouldn't Willow (literally overflowing with 'dark' magicks) be considered mentally incapacitated at the very least, and therefore not responsible for her actions? Not in an 'I'm so high on the bad stuff I don't know what I'm doing' sort of way, but rather in a truly altered state of reality. When she and Buffy are facing off in the Magic Box, she refers to the 'old Willow' in the third person, i.e. 'she' and 'her'. Makes me wonder if the magick might have taken control, not unlike a vampire's demon. 

Of course, it's more likely the writers were just blowing chunks, but what do I know.
